These Terms and Conditions ("Terms") govern your use of the website at huntingtonbeachasphaltpaving.com and any services provided by Huntington Beach Asphalt Paving ("we," "us," or "our"). By using our website or engaging our services, you agree to these Terms. Please read them carefully.
By accessing our website or requesting services, you confirm that you are at least 18 years of age, have the legal authority to enter into agreements, and agree to be bound by these Terms. If you do not agree, do not use this website or our services.
Huntington Beach Asphalt Paving provides asphalt paving, sealcoating, repair, striping, and related services for residential and commercial properties in and around Huntington Beach, CA. The scope of any specific project is defined by a written estimate or contract provided to the customer before work begins.
We reserve the right to decline any project request at our discretion, including projects outside our service area or scope of work.
All estimates provided by Huntington Beach Asphalt Paving are based on information available at the time of the site visit and are valid for 30 days from the date of issue unless otherwise stated in writing. Estimates are not binding contracts. A final price is confirmed in a written agreement signed by both parties before work begins.
Prices may change if the scope of work changes, site conditions differ materially from those assessed during the estimate, or material costs increase significantly between the estimate date and the scheduled work date. We will notify you of any pricing changes before proceeding.
All prices are in US dollars and do not include applicable taxes or permit fees unless explicitly stated in the written estimate.
Work dates are scheduled after a written agreement is signed. We reserve the right to reschedule due to weather conditions, equipment issues, or other circumstances beyond our control. We will notify you as soon as possible if a scheduled date needs to change.
If you need to cancel or reschedule, please contact us at least 48 hours before the scheduled start date. Cancellations made less than 48 hours before the start of work may be subject to a cancellation fee to cover mobilization costs already incurred.
Cancellation fee terms, if any, will be specified in your written agreement.
Payment terms are specified in each project agreement. Unless otherwise agreed in writing, a deposit may be required before work begins, with the remaining balance due upon completion of the work.
Invoices not paid by the due date stated in the agreement may be subject to a late payment fee. We reserve the right to suspend or stop work on any project where payment is overdue.
Accepted payment methods are listed in your written agreement. Payment disputes must be raised within 7 days of invoice receipt.
Where a workmanship warranty is provided, it will be stated in the written project agreement and covers defects in materials and workmanship under normal use conditions. Warranties do not cover damage caused by customer misuse, improper maintenance, third-party modifications, extreme weather events, or normal wear and tear.
THE WEBSITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF INFORMATION.
Asphalt surfaces are subject to natural weathering and wear over time. Discoloration, minor surface variations, and normal aging are not defects and are not covered under any workmanship warranty.
To the fullest extent permitted by applicable law, Huntington Beach Asphalt Paving shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of this website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from services rendered shall not exceed the amount paid by you for the specific project giving rise to the claim.

We are not responsible for damage to unmarked underground infrastructure or property that was not disclosed prior to work beginning.
If a dispute arises related to our services, we ask that you contact us directly first at quotes@huntingtonbeachasphaltpaving.com so we have the opportunity to resolve it. We aim to respond to all written complaints within 5 business days.
If the dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing litigation. Any unresolved dispute shall be subject to the exclusive jurisdiction of the courts of California.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal action related to these Terms or our services shall be brought exclusively in the courts located in CA.

You may not reproduce, distribute, or create derivative works from any content on this site without our prior written permission.
